Physiotherapist suspended on grounds of misconduct / Gwahardd ffisiotherapydd am gamymddwyn

Physiotherapist suspended

Joanne L Lee has been suspended from the HCPC Register for a period of twelve months on the grounds of misconduct whilst employed as a physiotherapist with Betsi Cadwaladr University Health Board.

A panel of the HCPC Conduct and Competence Committee heard that Mrs Lee removed approximately 817 patient records from the health board premises without consent and stored them at her own home and the home of a colleague.

The Panel further heard that Mrs Lee admitted to removing the files during office renovations as she feared they would be accessed by workmen. She then moved the files to her colleague’s home due to concerns that the files, which she had returned to the office in plastic carrier bags, would be the subject of scrutiny by her head of department on an upcoming office tour.

Panel Chair Manuela Grayson commented:

“In the Panel’s view Mrs Lee’s behaviour had fallen seriously short of that expected of a physiotherapist. The service user files being unavailable resulted in the Health Board undertaking either full re-assessment, or further assessment, of service users. This further assessment may have unnecessarily resulted in further intimate or invasive re-examinations, which in turn may have caused additional physical and emotional distress for some service users.”

The Panel ordered for the name of Joanne L Lee to be suspended from the HCPC Register for a period of twelve months.

Mrs Lee was neither present nor represented at the hearing.

Mae enw Joanne L Lee wedi’i dynnu oddi ar Gofrestr y Cyngor Proffesiynau Iechyd a Gofal am gyfnod o ddeuddeg mis ar sail camymddwyn pan oedd yn cael ei chyflogi fel ffisiotherapydd gan Fwrdd Iechyd Prifysgol Betsi Cadwaladr. 

 Clywodd Panel Ymddygiad a Chymhwyster y Cyngor fod Mrs Lee wedi mynd â thua 817 o gofnodion cleifion oddi ar eiddo'r bwrdd iechyd heb ganiatâd ac wedi'u cadw yn ei chartref hi ei hunan ac yng nghartref cydweithiwr. 

 Clywodd y Panel ymhellach fod Mrs Lee wedi cyfaddef symud y ffeiliau pan oedd ei swyddfa'n cael ei hadnewyddu oherwydd ei bod ofn y byddai gweithwyr yn eu gweld.  Yna, er ei bod wedi’u symud y ffeiliau’n ôl i’r swyddfa mewn bagiau plastig, fe’i symudodd unwaith eto i gartref cydweithiwr oherwydd ei bod ofn y byddai pennaeth ei hadran yn eu darganfod pan fyddai ar daith o amgylch y swyddfeydd.  

Meddai Cadeirydd y Panel, Manuela Grayson:

“Ym marn y Panel, roedd ymddygiad Mrs Lee ymhell islaw’r safon a ddisgwylir oddi wrth ffisiotherapydd.  Oherwydd nad oedd ffeiliau defnyddwyr y gwasanaeth ar gael, bu’n rhaid i’r Bwrdd Iechyd ail asesu defnyddwyr gwasanaeth, un ai’n llawn neu yn rhannol.  Efallai nad oedd gofyn cynnal rhai o'r ailasesiadau ac o'r herwydd bu'n rhaid i rai defnyddwyr gwasanaeth ddioddef ail archwiliadau helaeth, rhai ar fannau preifat o’r corff, a allai fod wedi achosi rhagor o ofid corfforol neu emosiynol.”  

Gorchmynnodd y Panel i enw Joanne L Lee gael ei dynnu oddi ar Gofrestr y Cyngor Proffesiynau Iechyd a Gofal am gyfnod o ddeuddeg mis. 

Nid oedd Mrs Lee yn bresennol nac yn cael ei chynrychioli yn y gwrandawiad.

6. The HCPC regulates social workers in England. Social workers in Northern Ireland, Scotland and Wales are separately regulated by the relevant Care Council in that country.
